Introduction

The website www.dinnerinthesky.pt is owned by the company Asteroide Misterioso – Unipessoal Lda., headquartered at Rua Pedro Alvares Cabral nº24, 2ºF Infantado, tax ID number 517482762, hereinafter referred to as Dinner in the Sky Portugal.

Customers of the Dinner in the Sky Portugal Online Reservation System (www.dinnerinthesky.pt) agree to comply with the following terms of use before, during, and after the purchase of seats. These terms and conditions should be carefully read before purchase, and any doubts should be clarified directly with Dinner in the Sky Portugal via email (contact@dinnerinthesky.pt) before purchase, as it constitutes acceptance of these terms and conditions.

The Organizer, Dinner in the Sky Portugal, has the right to change the Terms and Conditions and is obligated to publish them on official channels, namely the website www.dinnerinthesky.pt.

Website usage conditions

The user must be at least 1.30m tall to purchase a seat.

The user must use the website www.dinnerinthesky.pt compliance with applicable legislation.

The www.dinnerinthesky.pt website may contain links to other websites, which may contain information/tools useful to its users. These Terms and Conditions do not apply to third-party websites. Therefore, if the user visits another website redirected from www.dinnerinthesky.pt, they must read and accept the terms and conditions and privacy policy of that website.

1.1 – Intellectual property

All content and information on the website www.dinnerinthesky.pt are the property of the company Asteroide Misterioso – Unipessoal Lda., or have been licensed to it. Therefore, the use, reproduction, copying, and disclosure by other means of logos, texts, images, and videos or intellectual property on the website are subject to prior authorization.

1.2 – Product and price information

Dinner in the Sky Portugal considers essential information about the experience, providing clear and detailed descriptions to its customers.

The total price of each seat/experience, including fees and taxes, will be clearly visible to all users of the site. Depending on the selected payment method, such as international credit cards, fees generated by the bank are not the responsibility of Dinner in the Sky Portugal.

Dinner in the Sky Portugal cannot be held responsible for any computer, manual, technical, or other errors that cause a substantial, unforeseen change in the public selling price listed on Dinner in the Sky Portugal. In such cases where the price is exorbitant or manifestly negligible, the purchase request will be considered invalid and canceled, and the customer will be informed of this fact.

1.3 – Payment methods

For the convenience of the customer, Dinner in the Sky Portugal provides the following payment methods:

Cartão Visa, MasterCard, American Express, Multibanco, Google Pay, Apple Pay, Paypal, SEPA, GiroPay and iDeal.

Seat experience purchase conditions

2.1 – Seat availability

All available seats for purchase will be visible on the Dinner in the Sky Portugal website with date, time, and price. The available seats are limited to the maximum capacity of the table and may become unavailable without notice.

In case of seat unavailability after payment, Dinner in the Sky Portugal will inform the customer of this fact with a view to rescheduling or refund within a maximum period of 14 (fourteen) days from the date of knowledge of that unavailability.

2.2 – Terms of use for purchased seats

The Dinner in the Sky ticket is valid for the date and time selected by the customer. 1 seat equals 1 person.

The seat holder must be at the location 30 minutes before the selected time and must present the ticket to participate in the event. Dinner in the Sky may deny access to the event if the customer is late, does not have the ticket, or shows signs of intoxication.

Reselling of seats is prohibited. We reserve the right to cancel any seat/seats that have been resold.

Pregnant women and children under the 1,30m cannot participate in the events. Individuals under 16 years old can participate with the accompaniment by an adult.

2.3 – Cancellation, No-Show and Refund Policy

Dinner in the Sky Portugal operates a strict no-cancellation and no-refund policy.

Once a booking has been confirmed, cancellations are not permitted, and no refunds will be issued under any circumstances related to the customer’s inability to attend the booked session.

In particular:

  • No-shows (failure to attend the booked session at the scheduled date and time) are non-refundable
  • Late arrivals resulting in missed participation are treated as no-shows
  • The customer is solely responsible for ensuring availability at the selected date and time

This policy is clearly communicated during the booking process and forms an integral part of these Terms and Conditions.

2.4 – Weather and Operational Conditions

In the event of unforeseen and extreme weather conditions, or other operational or safety-related circumstances that prevent the experience from being conducted safely, Dinner in the Sky Portugal reserves the right to reschedule the experience.

In such cases:

  • Customers will be informed up to 24 hours in advance where possible
  • Customers will receive a voucher of equal value to rebook the same experience at a later date
  • Refunds will not be issued in these circumstances

2.5 – Exclusion of the Right of Withdrawal

In accordance with applicable consumer protection legislation, including Decreto-Lei n.º 24/2014, the statutory 14-day right of withdrawal does not apply to contracts for services related to leisure activities where a specific date or period of performance is agreed.

Dinner in the Sky experiences constitute time-specific leisure services, booked for a fixed date and time slot selected by the customer at the time of purchase.

By completing a booking, the customer expressly acknowledges and agrees that:

  • The service is provided on a specific date and time
  • The contract falls under the legal exception set out in Article 17(1)(k)
  • No right of withdrawal or cancellation without cause applies, including within the standard 14-day period

LIABILITY WAIVERLiability Waiver and Assumption of Risk for Dinner in the Sky Portugal

By checking the box online, I confirm and declare that I am participating in the Dinner in the Sky experience operated by Asteroide Misterioso – Unipessoal Lda. at my own risk.

Medical Fitness Declaration: I am in good health and do not have (or have not recently had) any medical conditions that could endanger my safety or others', including but not limited to heart conditions, high blood pressure, back problems, prostheses, severe dizziness, epilepsy, or pregnancy. I am not under the influence of medication, alcohol, drugs, or any substances that impair my comprehension or coordination. I am at least 18 years old, or if between 14 and 18, I have parental/guardian consent.Assumption of Risk: I understand that this experience involves being elevated by crane to significant heights, which carries inherent risks such as falls, equipment failure, weather impacts, or physical strain, despite safety measures. I voluntarily assume these risks and agree to follow all safety instructions provided by staff.Limitation of Liability: To the extent permitted by Portuguese law (including Civil Code and consumer protection laws), I release and hold harmless Asteroide Misterioso – Unipessoal Lda., its staff, contractors, and affiliates from any liability for injury, damage, or loss (physical, material, moral, or otherwise) arising from participation, including negligence (except gross negligence or willful intent). This includes waiving claims under applicable laws.Voluntary Participation: I have read and understood this waiver fully and agree to it of my own free will. No refunds for non-participation after booking.
